Bankruptcy // No matter your financial status, I'll determine the best form of action to help preserve your earnings.

Chapter 7 Bankruptcy

Chapter 7 bankruptcy is known as liquidation or “fresh start” bankruptcy. Trustees in Chapter 7 cases, assigned by the U.S. Trustee’s Office or chosen by the debtor’s creditors, may liquidate or sell the debtor’s non-exempt assets to pay all or a portion of the debts owed to creditors. As a practical matter, you, as a debtor, typically can protect all of your assets by using state or federal exemptions. It’s my duty to make this process go smoothly, so you can move on to the next chapter of your life.

Creditor Harassment

The federal Fair Debt Collection Practices Act (FDCPA) protects you from unfair collection acts, including harassing calls and calls outside of normal business hours. It does not give you the right to avoid your debts. It only gives you the right to protest if a debt collector does not correctly handle bills, payments, or credit issues. If you owe the money, you still owe the money, but that does not mean that a bill collector can call you at all hours or harass you. You have the right to be treated fairly. My mission is to ensure that you are.

Utility Shut-offs

If you are facing an imminent shut-off of a vital utility service, such as gas, water, or electric service, or you are having trouble affording your utility bills, there are ways to get help. I can help you better understand these methods and identify the best course of action, so you can get your utilities running again, quickly and affordably.

Garnishments

If you’re unable to pay your debts, you could be subject to wage garnishment. This means the court requires your employer to pay a portion of your wages directly to a creditor to which you owe money. If you are subject to wage garnishment, I can help you identify the best course of action to stop it.

Lawsuits

With debt often comes a whirlwind of legal matters, such as lawsuits from credit card companies and lawsuit judgments, among others. As your attorney, I can represent you in court during such lawsuits, ensuring you have the ability to defend what is rightfully yours.
